After restoration of the jirga, the first-ever case of land dispute under Alternate Dispute Resolution (ADR) Rules 2019 was registered on Wednesday. According to Landi Kotal Additional Assistant Commissioner Shamsul Islam, two parties of Khuga Khel tribe who had a dispute over a piece of land since long approached the assistant commissioner’s office through an application and asked him to solve their case as convener. It is to be mentioned here that last week, the government announced implementation of ADR Rules 2019 in merged tribal districts for solution of all civil cases. Shamsul Islam added that under the ADR Rules 2019, the application would be lodged in the office of the assistant commissioner, Landi Kotal, who would be authorised to formulate a jirga from a 50-person list of jirga members already nominated for resolving the conflict. However, he said that the tehsildar office would be made the base office for the whole process. As per the rules, the case will be solved within two months, he said, and added that approval of the both quarrelling parties was necessary for filing case under ADR rules. Instead of the Dispute Resolution Council (DRC), the ADR would function in the merged tribal region. When one of the applicants, Khayal Rasool, was contacted, he said that he was economically unstable and could not bear expenses of a lawyer; therefore they jointly filed an application in the office of the assistant commissioner for solution of their quarrel. He maintained that in two days their application was put in process and in the coming few days they would get justice.
