The Federal Constitutional Court on Monday heard a case concerning the alleged disqualification of National Assembly member Sohail Sultan from Swat and issued notice to the Attorney General seeking assistance on constitutional and legal questions involved in the matter.
During the hearing, the Court sought the Attorney General’s assistance and raised the question whether the Office of the Speaker of the National Assembly can send a reference regarding a disqualification dispute before elections.
The Court also asked the Attorney General to clarify whether the Election Commission has the authority to hear a reference relating to a pre-election disqualification dispute.
Counsel for Sohail Sultan, Barrister Gohar, argued that in cases of this nature neither the Election Commission has the jurisdiction to hear the matter nor can the Speaker of the National Assembly send such a reference.
A two-member bench headed by Justice Aamir Farooq heard the case and adjourned the proceedings for an indefinite period.
