ISLAMABAD: The Supreme Court (SC) has sought explanation from the National Accountability Bureau (NAB) over allegedly misleading the court in a case involving Opposition Leader in National Assembly Khurshid Shah and former Ministry of Labour and Manpower secretary Arif Azeem for making “illegal appointments” in the Employees Old-Age Benefits Institution (EOBI). The apex court also directed to remove the name of Arif Azeem from the Exit Control List (ECL). However, the court further ruled that adjudication in contempt proceedings of the instant matter against rest of the respondents had not been withdrawn. A two-judge bench headed by Chief Justice Anwar Zaheer Jamali on Thursday resumed the contempt case against EOBI Chairman Zafar Gondal and others for allegedly making illegal appointments in the institution in 2010. During the course of hearing, the National Accountability Bureau (NAB), in pursuance of the court’s directives, submitted a report stating that Syed Khurshid Shah was the labour and manpower minister from March 31, 2008 to May 2011, when in violation of a court’s order, appointments were made in the EOBI. The court was also apprised that the former labour secretary was on “awaiting posting” notice in the Establishment Division since April 01,2016. Barrister Aitzaz Ahsan, counsel for Syed Khurshid Shah, submitted a miscellaneous application before the court stating that his client was not minister during the period the NAB had mentioned before the apex court. He contended that NAB was continuously misleading the apex court. Tariq Jahangiri, counsel for Arif Azeem, informed the court that his client was in United States for a medical check-up. He added that his client did not receive any notice from the NAB before leaving the country, adding that without any justification his client’s name was placed in the ECL. While expressing displeasure, the chief justice of Pakistan said that the court would definitely impose fine after taking legal action against the NAB official concerned, who misguided the court and defamed a government servant. Later, the hearing of the contempt case was adjourned.
