India occupied part of Kashmir in its control on 27 Oct 1947, started eroding its nominal autonomy from 1954 and completed integration on 5th August 2019 bewildering all and sundry The un-combated occupation of Siachen in 1984 followed by implicit acquiescence by Pakistan & Parliamentary resolution of 1994 by India , were the preludes to what has started unfolding on and after 5th August . Through Constitution Application to J& K order , dated 5th August 2019 , the GOI applied , Art 367 of its constitution with soft and benign amendments to Jammu & Kashmir under Art . 370 , twisting the interpretations in a manner that whole of its constitution is extended to state by abrogating the state constitution along with all presidential orders from 1954 , including Art 35A . Art 370 is renders redundant , but kept it in-tact for another mischief after state Assembly comes in to being . It was followed by J & K Reorganisation Act 2019 , which came into force on 31 ST Oct 2019 , through which the state is disintegrated , down graded and bifurcated in two parts to be governed as a Union territories directly under Delhi rule , besides reasserting its claim for “liberating ” the Pakistani controlled parts of state . With this , sang Parivar accomplished its mission of extinguishing 174 years old identity and statehood of 140 million people, spread over more than eighty four thousand sq. miles . Now it is on the path of accelerating the process of changing its demography . We must remain prepared for out of box resolution as well, based on ground realities and aspirations , with the consensus of subjugated people which must include resolution of all disputes between India and Pakistan for ever lasting peace To begin with , many Indian states & Private business enterprises have allocated and offered billions of dollars to purchase land and make private investment in the state . Construction of retired army personals colonies is on cards . state flag is removed. Hindi is made the official language along with English. India has started changing the historical names of public places & cities, obtaining bonds of loyalty from detainees not to speak against 5th August action, getting declaration from government employees to have voluntarily accessed to India and to remain loyal to it, reconstructing allegedly fifty thousand temples and much more , besides luring the state politicians to accept the present position first, and then demand restoration of status qua ante . Sanctions &restrictionists are so strict that they look like curfew but there is nothing on paper like curfew to escape from the world ire. Pakistan can and it must , pre-empt to thwart the nefarious effort. India claims legitimacy of its action under its constitution and to be its internal matter , though it runs against Articles 3, 51, 253 and 370 of its own constitution and a brazen negation of specific UNSC RESOLUTIONS Dated 30th March 1951 and 24 January 1957. Indian leaders and army chief have become more vociferous for territories of Kashmir under Pakistani control after merger of state in its occupation in Indian main land. The claims go un combated with precision. These should have been stressed on the floor of UNGA to create a diplomatic stir and must be vehemently asserted in future . Every legal bullet need to be fired against adversary at every stage. I am apprehensive of India’s adventurism under Modi Sarkar , given its claim to and followed by relentless bombing and firing on AJK & Gb , which are not included in Pakistan constitution as its territories , but India claims them consistently . My apprehensions of Indian adventurism may be far fetched and mis – founded , but Siachin occupation is its classical precedent . This needs a serious thought at appropriate level for appropriate action. In my humble perception after above unilateral actions of India , all bilateral agreements and understandings between India & Pakistan for resolution of Kashmir issue , except to the extent to which they have been acted upon , stand annulled and only UN RESOLUTIONS remain in field . The ” line of control ” has reverted back to ” Cease fire line ” . Pakistan should unequivocally declare so and get rid of bilateral sermons given by world in reply to its appeals for resolution of Kashmir conflict . Kashmiris around the world, particularly in valley , are not going to give in . They have combated the unconstitutional action and stringent military measures by sever, but civilised resentment across the board, which has caught the imagination of world civil societies, media, human rights associations and think tanks. It has unnerved India , so much so that it has begun to seek legitimacy from like minded European Union Members , a third party intervention , which India had been denying . Pakistan need to seize the moment and stress world powers to visit and see for themselves the pathetic position on ground in Kashmir . What needs to be stressed is it to settle cause of restrictions, not restrictions only . India has now placed mainstream political leadership with others in one compartment and driven by one stick . Pakistan needs to offer to all shades of Kashmiri leadership to give them all that they want from India within the parameters of art 257 of Pakistan constitution which is flexible enough to accept the “WISHES OF KASHMIRIS ” AND , WISHES CAN NEITHER BE LIMITED NOR IGNORED . To inspire confidence in Pakistan’s offer , and in the absence of not being its constitutional part, AJK Govt including GB , need to be given a constitutional role at least equal to pre 1947 position of Kashmir, to plead the case of Kashmir in and out of country . The policy to act as Vakeel, Ambassador or Attorney of Kashmiris has not borne any fruit till date . Conversely , it has deepened the democratic deficit in AJK & GB and nurtured suspicions in Kashmiris across the board . The world hears, believes and helps principal victim party , none else . The policy on Kashmir , therefore , needs to be re-evaluated accordingly without changing the goal and , subject to the spirit of UNCIP RESOLUTIONS and UN CHARTER , if it intends relief and resolution for Kashmiris and Kashmir , instead of keeping Indians engaged in the state . we have experience of watching how India adjusted its policy on Kashmir from time to time without compromising on its principal stand while Pakistan following the half hearted One wonders why Pakistan follows half hearted reactionary policy but claims whole state as a matter of right ? We must remain prepared for out of box resolution as well, based on ground realities and aspirations , with the consensus of subjugated people which must include resolution of all disputes between India and Pakistan for ever lasting peace . After 5th August action , the journey to vacate occupation has become longer but, more easier, smoother and possible . But it requires smart , aggressive and relentless diplomacy through personal contacts , not by twitter or Telephone . If it can’t go beyond what it is doing , let it build its own image , stabilise Pakistan politically and strive for its economic independence . That will help Pakistani people directly and Kashmir cause indirectly . Half hearted and fearful policies are not going to help Pakistan and least to Kashmiris.
