Disney faces lawsuit over Avatar character likeness claims

The Walt Disney Company and director James Cameron face a lawsuit in a California federal court after an actor accused them of misusing her facial likeness for the character Neytiri in the globally successful Avatar film franchise. The complaint claims the filmmakers used her features without consent and turned them into a major commercial character.

Actor Q’Orianka Kilcher alleges that Cameron extracted, replicated, and commercially used her facial structure when designing the CGI character Neytiri. She claims the process violated her publicity rights and involved taking biometric facial features from her earlier acting work without permission or proper compensation.

According to the lawsuit, Kilcher’s legal team argues that the director used her image from the 2005 film The New World as foundational reference material for the Avatar character design. The complaint states that this image formed part of a digital creation process that later contributed to a franchise generating billions of dollars globally.

Moreover, the legal filing argues that the Avatar films present themselves as supportive of Indigenous cultures while allegedly relying on the likeness of a real Indigenous actress during development. The complaint further claims this contradiction raises serious ethical concerns about representation, consent, and profit-making within modern digital filmmaking practices.

Meanwhile, representatives for Disney did not immediately respond to media requests for comment on the lawsuit. The company and James Cameron have not yet publicly addressed the allegations, even as the case draws attention due to the global success and cultural influence of the Avatar franchise over the past decade.

Additionally, the lawsuit seeks financial damages under California’s right of publicity law, which protects individuals from the commercial use of their identity without consent. Avatar remains one of the highest-grossing film franchises in history, with its sequels continuing to generate major box office revenue worldwide and maintaining strong global audience interest.
