President Zardari reaffirms enduring role of Constitution

President Asif Ali Zardari on Thursday emphasised the enduring significance of the Constitution adopted on 10 April 1973, describing it as the central legal and political framework of the state.

The president, in a message on Constitution Day, noted that the 1973 Constitution represented the first instance in which a directly elected Parliament, based on adult franchise, established a consensual constitutional order after more than twenty-five years of uncertainty and earlier unsuccessful attempts.

He highlighted that its adoption followed a prolonged and challenging process requiring sustained negotiation, restraint and political consensus across party lines.

Describing the Constitution as federal, parliamentary and democratic in nature, the president underscored that it was endorsed by all political parties represented in Parliament at the time, an achievement he termed one of its defining strengths.

Reflecting on the past five decades, the president observed that Pakistan has faced multiple challenges, including military interventions, authoritarian rule, externally supported terrorism, natural disasters, economic pressures and the loss of national leaders through assassination and judicial actions. Despite these disruptions, he said, the Constitution has remained a source of continuity and institutional recovery.

Paying tribute to Shaheed Zulfikar Ali Bhutto, the president acknowledged his role as the principal architect of the 1973 Constitution, whose leadership helped unite diverse political forces at a critical moment.

He also recognized the contributions of democratic political parties that defended the Constitution during times of strain.

The president also remembered Shaheed Mohtarma Benazir Bhutto for her struggle for democratic governance under difficult conditions following martial law. He noted that her efforts, alongside other leaders, led to the Charter of Democracy in 2006 and the restoration of democratic rule.

He added that after her martyrdom, he chose to serve as a ceremonial Head of State and returned executive powers to Parliament that had been assumed under previous dictatorial regimes.

Emphasizing the practical relevance of the Constitution, the president stated that it was a living document that shaped everyday governance. He explained that it governed judicial proceedings, public administration, education systems and citizen interactions with state institutions, as well as relations between federating units and the federal government.

The president stated that the Constitution is the creation of Parliament, representing the people who were the true custodians of the nation’s destiny. He called for reflection on its enduring role, stressing that its continued relevance depended on its faithful application in institutions and daily governance.
