ISLAMABAD: Representatives of lawyers community under the banner of Pakistan Bar Council (PBC) and Supreme Court Bar Association (SCBA) have given an ultimatum of 15 days for formulation of terms of references (ToRs) for investigation into Panama leaks. “If parliamentary committee fails to formulate ToRs within 15 days, all the options are open for the legal fraternity including ‘lawyers movement’ as well as filing of constitutional petition against federal government under Article 184(3),” PBC and SCBA jointly resolved. Similar to the lawyers’ movement launched for restoration of judiciary in 2007, many lawyers present at the convention termed the gathering as prologue to another ‘lawyers movement’ against the corruption. However, confusion still persists over modus operandi separately proposed by both the bodies for investigation into Panama leaks as SCBA demands an ordinance for establishment of the commission and formulation of the ToRs while PBC believes that no special legislation is required. The lawyers’ representatives further resolved that the legal community will announce its strategy and advise the nation on how to deal with the situation after waiting for the outcome of deliberations of the parliamentary committee for two weeks. They further resolved that the chief justice of Pakistan may nominate two eminent judges, sitting or retired, of the Supreme Court and a legal expert of eminence as members of the commission which should have the powers to constitute an international joint investigation team from international agencies to provide information, documents, evidence and record from abroad by directing the government of Pakistan to move the mutual legal assistance requests (MLARs). PBC Vice-chairman Dr Farogh Naseem in his address to the convention said that the matter of ToRs is in the hands of parliamentary committee but he has no hopes of fruitful results from parliamentarians, adding only judiciary can take effective steps over Panama leaks. “We do not want to derail the democracy but democracy should not be taken as license for corruption,” he said, adding the legal community was united on the matter.
