For opposition parties and technocrats, it has been a political ritual to chant about government’s erroneous decision of funding Pakistan’s economy from IMF packagesconformedtoinsupportableterms and conditions. The people of Pakistan keep on raising their voice against inflation,unemployment, poverty, external debt, fiscal deficit, sinking growth of GDP and deteriorated balance of payment. The solution of all economic problems could be traced in a dedicatedconfiguration of economic constitution. The economic constitution necessitates a legal structure that constraints the choices and activities of the economic and political agents. The concept of economic constitution canpotentiate a third way between laissez-faire liberalism and socialist politics, emphasizing the role of executive institutions over legislative ones. The political constitutionaims at protecting a state’s territorial rights, human rights and freedom of speech. But economic constitution accentuates economic rights and pecuniary emancipation. Surrounded by economic glitches, the present day Pakistan could revise its economic system throughlegitimate processes, paving the road for formation of economic constitution. Judiciary protects the constitution. The economic stability can be achieved only if the judicial aficionados are aware of the philosophy of constitutional economics. Proper clauses, covering the scope of economic policies, could be discussed and recognized in the National Assembly and all the quota seats could be allocated to technocrats for making others understand the way the economy works. People of Pakistan should be cognizant of national economic targets, so that the respective institutions could be held accountable. Setting up economic courts could work. The NAB cases could be concluded in economic courts working under Pakistan’s economic constitution. It could eliminate NAB’s shadowy past. The political constitution aims at protecting a state’s territorial rights, human rights and freedom of speech. But economic constitution accentuates economic rights and pecuniary emancipation The institutions supposed to deal with Pakistan’s economic constitution include Ministry of Planning and Development, Federal Board of Revenue, Ministry of Trade and Commerce, Ministry of Finance,State Bank of Pakistan and financial institutions regulatory bodies in consonance with economic framework of IMF, WB, OECD and WTO. Major challenges in designing a right economic constitution seem to come fromIMF and WB. Equality is an underlying feature of the political constitution that defines public welfare goals. Equality is about giving every stratum of society an equal access to opportunities and advantages. Under the auspices of political constitution, the rich ones becomeeven wealthier and the middle income groups move toward betterment at a slower pace. However, the scope of economic constitution is broader than the concept of equality; it focuses on the value of equity that speaks of equitable opportunities for all. Equity aims at brining equality in a relative logic, acquiring excessive assets from higher income segment of the society and giving to lower income section. The mystery of poverty appears to be resolvedby equitable resource distribution. The constitutional principles related to taxation policy, spending on public development, and formulation of budget supplemented by role of economic courts could be introduced under the shade of an economic constitution, thus, making the economypeople centric. Being scarce in nature, the economic resources must be utilized optimally. Uneconomic and inefficient utilization of resources could put a country’s fate at risk in the long-run. Pakistan’s economic emancipation could be achieved through sanctimonious jurisdiction of the proposed economic constitution.Marching on the fronts of economic constitution, Pakistan could reap the ripened fruits of competitive efficiency, productivity and comparative advantage. A common man could grasp his legal, ethical and political rights but might fail in justifying actions in economic terms. For instance, people buy food for paying a particular sum of money; they cannot be held culpable if they eat up a portion and waste the remaining stuff.Speaking on economic lines, this wastage is equivalent to compromising the needs of upcoming generation. A well-structured economic constitution could prescribe rules and regulations in combination with punitive actions to teach people regarding intelligent utilization of Pakistan’s natural and capital resources. Higher Education Commission of Pakistan could pay heed to launch specializations in Constitutional Economics. Promoting corporate level constitutional economics could incorporate a better understanding of economic rights and obligations amongst Pakistan’s future leaders.The political parties, underthe economic constitution,could be able to craft more people oriented policies based upon the principles of equity and equality. Such policies could have strength to pull half the population out of poverty. Being superior in nature, the economic constitution could bolster the foundations of democratic values in the country. Economic policies could only be scrutinized and reformulated when the constitution dictates the parliament to give economic issues a due consideration.
