KARACHI: The Sindh High Court ordered the district registrar Karachi (DRK) to ensure that no sale deed, lease deed or sub-lease deed in respect of any property without a completion plans is registered. A two-judge bench headed by Justice Nadeem Akhtar ruled, “No sale deed, lease deed and sub-lease deed shall be registered by any sub-registrar in any part of the province of Sindh in respect of any property or land unless completion plan issued by the competent authority in respect of the construction is made part and parcel of such deed and the sub-registrar concerned shall affix his seal or stamp and put his signature on the completion plan as well at the time of registration.” It also directed the Board of Revenue (BoR) to refer the matter involving three sub-registrar having registered leases without completion plan to the anti-corruption department for taking appropriate action against them. Ghulam Abbas, district registrar Karachi, informed that three sub-registrars – Imdad Ali Qureshi, Zohaib Nazar and Aftab Ahmed Korai – who had registered sub-leases in respect of a property in violation of Section 18-G of Sindh Building Control Authority Ordinance 1979, are under suspension. He stated that concrete measures were being taken by the department as well as by the Board of Revenue to ensure that no such illegal act is committed in future by any sub-registrar. He said that circulars had been issued from time to time directing all sub-registrars to comply with the mandatory requirements under the law at the time of registration of documents.The hearing was adjourned till April 05.
