Court Drops Challenge to 27th Amendment

Court Drops Challenge to 27th Amendment

The Lahore High Court dismissed a petition against the 27th Amendment after the petitioner chose to withdraw it. The judge asked the government about the amendment’s status, and officials said it was still under review. The court then allowed the petitioner to pull back the case. The withdrawal ended the hearing for now, but the issue remains active.

The petitioner had argued that the 27th Amendment introduced major constitutional changes. He claimed the amendment would weaken the Supreme Court by shifting key powers to a new Federal Constitutional Court. He also argued the move threatened judicial independence. Moreover, he said the amendment advanced without proper consultation with provinces.

The government told the court that the amendment was still undergoing changes. Officials argued that the petition was premature and not suitable for hearing. This statement led the court to question the petitioner about continuing the case. As a result, the petitioner chose to step back until the amendment process was complete.

The proposed 27th Amendment has already passed the Senate and reached the National Assembly. Supporters say it aims to reorganize the judicial structure. Critics argue it undermines the Supreme Court by reducing its original, appellate, and advisory authority. They believe the new Federal Constitutional Court would reshape the judicial system in a significant and controversial way.

The petitioner plans to file a fresh case once the amendment process is finalized. The debate over the 27th Amendment will likely continue as political and legal circles watch closely. Many expect new petitions and stronger challenges once the amendment reaches its final stage and becomes enforceable.
