PESHAWAR: The Peshawar High Court (PHC) on Monday issued non-bailable warrants for the arrest of Shamim Akhtar Kiyani, the woman who claims to be the wife of a late senator and Awami National Party leader, for not complying with the court orders.The court had directed Kiyani to appear in the court in person in a case against her, but she did not.The former federal minister, late Senator Azam Khan Hoti, had filed a case against Kiyani for uploading and sharing his and his family’s pictures on Facebook.A two-member bench consisting of Justice Waqar Ahmad Seth and Justice Rooh-ul-Amin Khan issued the non-bailable warrants for Kiyani’s arrest. The bench said the court had restrained Kiyani from using any material against Hoti and his family. It said the parties shall not indulge in character assassination campaign against each other. However, the bench stated that as per the record produced in the court by the petitioner’s widow Humaira Azam Hoti, Kiyani was using the name and material on Facebook, which was a violation of the court orders.Besides, the bench said the high court summoned Kiyani on November 11, 2014 and on December 16, 2014 to appear in person in the court, but she did not appear and violated the court orders. “We are issuing non-bailable warrants for Kiyani’s arrest, as there is nothing on record that she appeared in the court after the court orders,” the court stated and fixed June 22 as the next date of hearing.Both Hoti and his wife Humaira Hoti filed writ petitions against Kiyani in 2013 and said that she was maligning and defaming them and their family. They said that she uploaded private pictures of the complainants to Facebook with obscene and indecent comments. During the hearing of the case, counsel for Hoti, Sabitullah Khan Khalil, submitted to the court that Kiyani was using Hoti’s name and uploading objectionable material to social networking sites against his clients despite the court’s restraining orders. Deputy Attorney General Kifayatullah Khan, representing the FIA and the PTA, submitted that the FIA on April 6, 2016 registered an FIR against the woman and the Cyber Crime Wing of the agency started investigation into the case. He informed the bench that she was not arrested in this case.At previous hearing, Director (Legal) of the FIA Muhammad Imran and Investigation Officer Fazal Ma’abood submitted a copy of the FIR filed against Kiyani. The FIA Cyber Crime Circle registered the FIR on the complaint of Humaira Hoti on April 14, 2016 wherein it was stated that Kiyani uploaded private pictures of the complainant to the social media with mala fide intentions.
