A Sindh High Court (SHC) bench headed by Justice Ashraf Jahan has issued notices to federal and provincial government of Sindh on a petition challenging the imposition of income tax on immovable property (real estate) by the federal government. The petition was filed by businessman Ghulam Hussain Memon. The petitioner’s counsel Barrister Zamir Ghumro argued that federal government has no power under the constitution to impose income tax on real estate since this subject comes under the provincial government. “This tax is being imposed from 2012 without lawful authority,” the council further aruged, adding that constitution is clear on this point and the Supreme Court (SC) has already held that the federal government cannot levy tax on immovable property.
