KARACHI: Pakistan People’s Party (PPP) Karachi chapter’s President Dr Asim Hussain and a close aide of former president Asif Ali Zardari may have to wait for some time to walk out of jail as a two-judge bench has declined to hear his application, seeking court orders for accepting the surety without depositing passports. Dr Asim filed an application under Section 151 of CPC seeking courts’ directives for Nazir to accept the surety amount of Rs2.5 million in each reference without his Pakistan and Canadian passports. A two-judge bench, headed by Justice Muhammad Farooq Shah, refused to take up the application and referred the matter to the SHC chief justice for placing it before another bench. However, the application was sent to the senior puisne judge for appropriate orders since the chief justice was at Islamabad to attend the full court reference of Supreme Court to bid farewell to Justice Amir Hani Muslim who is retiring today. Justice Irfan Saadat Khan, who is the most senior judge after the chief justice, declined to pass any orders and ruled, “Let the application be placed before the chief justice tomorrow.” Dr Asim could have been released on Wednesday had the court not directed him to deposit passports with the surety amounts. His lawyer contended that since his passports were already deposited with an anti-terrorism court in a case related to treatment of suspected terrorists at his hospitals.
