Justice Athar Minallah heading a three-member bench comprising of Justice Amir Farooq and Justice Mohsin Akhtar Kiyani heard a case pertaining to construction in Bani Gala and Sector E-11.
During the hearing the large bench ruled any construction within the stated vicinities is illegal. Adding that any construction done against the Master Plan will be demolished.
The court remarked that the doctrine of necessity is a stranger to the rule of law, adding that this is the best example of adding the rule of one rather than the rule of law.
Moreover, the Judge asserted that justice delayed is equal to justice denied.
Earlier Shehzada Sikandarul Mulk along with other residents had challenged the constructions in Bani Gala and Sector E-11. The petition stated that the construction of commercial buildings in Bani Gala and tall buildings in Sector E-11 were against the Master Plan.
The petition said that the constructions had been done to benefit the upper classes against the Master Plan.
