PESHAWAR: The Peshawar High Court on Wednesday sought a reply from the Ministry of Defence after a widow claimed that her property was taken by the army which was allegedly receiving the income being generated from it. The bench headed by Chief Justice PHC Mazhar Alam Khan Miankhel while hearing a writ petition filed by widow Zahida Bibi through her lawyer Bashir Wazir was told that the petitioner’s husband Daulat Shah and a son Shujat Shah were picked by security forces in Kabal area of Swat district. Wazir argued that they accused of carrying out attacks on security forces and were kept at an internment centre where her husband died while the son was placed in category black. He said that 22 kanals of property, a house and a tractor was also confiscated by the security forces whereby the agricultural land and a tractor was given to the people on lease (Ijara). Wazir said that the security forces were receiving the income being generated from the property while the petitioner was the only heir alive who was passing a distressed life. The chief justice inquired the petitioner’s counsel whether the property was attached to which he replied that it was not attached properly. The chief justice ordered the deputy attorney general to file a comprehensive reply within 14 days. The bench adjourned the case till July 14.
