BHC dismisses appeals against conviction

Balochistan High Court in Criminal Ehtesab Appeal titled as Abdul Razzaq Rind vs State dismissed the appeals filed by appellants against their conviction.

Accused Abdul Razzaq Rind has been convicted and sentenced to three-year rigorous imprisonment with fine of Rs 8, 00000 and in default of payment of the fine to further undergo imprisonment for six more months. Whereas, accused Abdul Nab (Nabi Baksh) and Jaffar have been convicted and sentenced to 2 year R.I with fine of Rs 8,0000 each in default of payment of fine to further undergo R.I for six month each. The accused persons have also been disqualified for a period of 10 years under section 15(b0 of the NAO, 1999.

Brief facts of the case are that Reference No 5/2008 was filed by NAB (Balochistan) against accused Abdul Razaq Rind and other on the allegation that accuese Abdul Razzaq Rind in the capacity of President, All Pakistan Clerk Association, Dera Murad Jamali on 19-03-2002, in connivance with other accused person namely Nabi Baksh and Muhammad Jaffar ,Tehsil daar and Patwari, Dera Murad Jamali at the relevant time, illegally sold 5 acres of land belonging to all Pakistan Clerk Association , Naseerabad to one Sadiq Ali Umrani ex MPA on a very meager price.

On 25-11-1997 board of revenue Government of Balochistan had transferred land measuring 82 acres wide mutation No. 789 Khasra No.171,172,173,174 and 175/1 , 181 and 182 as well as land measuring 18 acres vide mutation No 790 , Khasra No 171 and 183 in the name of President All Pakistan Clerk Association district Naseerabad for clerks association. Investigation reveals that on 19-03-2002 land measuring 5 acres bearing Khasra No 174 Mouza Juddar, Teshil Dera Murad Jamali was sold out by accused Abdul Razza Rind vide mutation No. 1412 to Sadiq Ali Umrani against a sum of Rs 60,000 in connivance with the revenue staff. The market value of the said land at that time was Rs 8, 00000 and at the time of filing of the Reference was about Rs 18, 00000.
