The court also directed Akbar to submit a detailed report on the matter in the IHC within three weeks.
The court was hearing a petition filed by the mother of Securities and Exchange Commission of Pakistan (SECP) Joint Director Sajid Gondal that sought recovery of her son from “unknown” abductors when the SECP official had gone missing earlier this month.
Akbar, along with Islamabad Deputy Commissioner Hamza Shafaat, Islamabad inspector general of police and interior secretary, appeared before IHC Chief Justice Athar Minallah.
Justice Minallah told Akbar that despite a court ruling, there was no prosecution branch in Islamabad. The judge said that the capital should have been a “model city”, adding that the “standard of police investigation is extremely poor”.
“Go to a katcheri and see how courts are operating, no one has paid any attention towards it,” Justice Minallah told Akbar.
“The court verdicts are based upon police investigation. The standard of police investigation is extremely poor, investigation officials have not been trained,” the judge added. He further said that many suspects are acquitted due to poor investigation by the police and the courts were deemed responsible.
The IHC top judge said that Akbar was among the five people who had been appointed by the prime minister as advisers and who had his trust.
“Tell the prime minister that the rights of a layman are being trampled upon,” Justice Minallah said.
Akbar said that the matter of missing persons had been brought to the cabinet’s notice and a sub-committee has been formed. The recommendations will be sent to the cabinet, he added.
“This is an ongoing issue,” Akbar told the court, agreeing that there should be an independent prosecution branch in the capital.
The petitioner’s counsel Barrister Jahangir Jadoon told the court that Gondal has returned and also recorded a statement before the magistrate. He added that authorities have yet to ascertain who was behind Gondal’s disappearance.
The judge said that the court could not comment on who was responsible for Gondal’s disappearance as the matter was being investigated by authorities.
“This is a matter under investigation, the law will take its own course,” IHC Chief Justice Athar Minallah remarked. The hearing was adjourned until October 19.
Gondal had gone missing earlier this month and his car was found from Park Road the next morning. His wife had submitted a complaint of the incident in the Shahzad Town police station, expressing suspicion that her husband had been “kidnapped by unidentified persons”. She urged the police to ensure his return, adding that the family “did not have any enmity”. Until that time, police did not lodge an FIR.
The next day, Gondal’s mother filed a habeas corpus petition in the IHC. Gondal returned five days after he went missing.
Meanwhile, IHC has reserved judgment on maintainability of contempt of court petition filed by a private transport company against communication minister Murad Saeed.
A single bench of IHC led by Justice Mian Gul Aurangzeb took up the case for hearing Monday.
Arif Chaudhry counsel for the petitioner told that the court had ordered to fully implement National Highways Safety Ordinance-2000 but court’s orders are not being implemented. Therefore, contempt of court proceeding be initiated.
Justice Mian Gul Aurangzeb remarked “that decision was my decision. Therefore, it will be appropriate that some other bench hears this petition.
The defense counsel Arif Chaudhry told the court this is your decision therefore, contempt of court plea has to be heard by you as well. Non implementation of axle load law is causing damage to national highways.
Meanwhile, Chief Justice (CJ) of Islamabad High Court (IHC) Athar Minallah has remarked ban on allotment of plots will stay unless the last affectee is paid the compensation.
CJ IHC Athar Minallah took up for hearing petition filed against the violation of court’s stay order on allotment of plots in federal capital Monday.
The court summoned the detailed report from DG Housing Foundation and DG Federal Employees Housing Society.
The court has barred CDA and housing foundation from allotting the plot since the last 11 months.
During the hearing of the case the CJ IHC remarked “who were the persons to whom plots were allotted despite court’s stay order. Give the report to court. Under what authority ministry of housing kept on allotting plots despite court’s orders. No one will be allotted plot unless compensation is paid to affectees. The ban will remain in place unless the last affectee of Islamabad is paid compensation.
The court had imposed ban on allotment of plots by CDA and Housing Foundation on October 25, 2019.
