KARACHI: The Sindh High Court (SHC) on Tuesday adjourned the hearing of a petition seeking action against the National Assembly speaker and directed the petitioner to make argument in the light of superior judiciary’s orders.
An SHC division bench was hearing the plea filed by Moulvi Iqbal Haider, a practicing lawyer and chairman of the Awami Himayat Tehreek Pakistan. Haider submitted that he sent a reference to the speaker of the National Assembly seeking disqualification of Prime Minister Nawaz Sharif for hiding his assets at the time of submission of his nomination papers before the last general election.
Instead of sending the reference to the Election Commission of Pakistan (ECP), he said, the speaker ruled the reference was not maintainable.
He requested the court to rule that the speaker had no authority to decide the questions raised through such references. “The Election Commission of Pakistan is the authority to decide the disqualification matter of any member, not the speaker. The speaker is bound under the constitution to refer any such reference to the Election Commission of Pakistan,” Haider said.
The court adjourned the hearing of the case and directed the petitioner to make his arguements as per superior judiciary’s orders, at the next hearing.
Also, the court adjourned the hearing of a petition seeking disqualification of the prime minister on the ground that he submitted a fake affidavit to the Election Commission of Pakistan at the time of submission of his nomination papers before the last general election.
The petitioner submitted that Sharif never disclosed that his family members owned offshore companies. He said the prime minister had hidden his assets and business from the Election Commission of Pakistan.
