ISLAMABAD: Chief Justice of Pakistan Justice Anwar Zaheer Jamali has taken notice of the killing of Barrister Fahad Malik on August 15 in Islamabad.
The notice was taken on a note of registrar containing the details of incident of firing in which Barrister Fahad Malik was killed. It further stated that the incident could have been averted if the vehicles had been checked and searched properly by the Islamabad police before the commission of crime.
Moreover, when the police saw that the two parties were antagonistic towards each other, they should have anticipated breach of peace and should have taken all precautionary measures in order to avoid a clash between them, it added.
On account of the lethargic attitude of the police department, the registrar’s note stated that one of the accused has initially succeeded in obtaining interim bail from the court of Islamabad District & Sessions Judge which has now been cancelled and the accused has been handed over to police on physical remand.
The lack of proper security arrangements by the administration constitutes violation of fundamental right to life and liberty which has been guaranteed under Article 9 of the Constitution. Taking notice of the issue, the chief justice has called a report from Islamabad inspector general of police, within one week.
