SHC issues notices to SBCA official for non-compliance

KARACHI: The Sindh High Court on Monday issued show-cause notice to the Sindh Building Control Authority’s director general to explain as to why its orders for pulling down an illegally constructed high-rise in the city’s North Nazimabad area were disregarded.

It once again directed the SBCA to take action against the illegal structure and submit the compliance report within three days.

A division bench of SHC was seized with the petition of a resident of North Nazimabad who had taken the SBCA to the court for allowing construction and commercialization of a multi-storey building in a residential area.

Petitioner Khizar Ahmed submitted that owner Haji Nazir had constructed a high-rise building on his plot in North Nazimabad for commercial purposes in violation of the building laws. Since it was a residential area, no building for commercial purposes can be allowed, he argued.

He told the judges that he had complained to the SBCA authorities to take action against illegal construction but his complaints fell on deaf ears. The petitioner requested the judges to order demolition of the building.

Earlier, a court official, who was appointed by the court to carry out inspection of the structure, confirmed that a multi-storey building was constructed, which was being used for commercial purposes. Subsequently, the court had ordered the SBCA to take action against the structure as per laws.
