LHC moved against appointment of CJP’s wife as FSC judge

LAHORE: Barrister Javed Iqbal Jafree moved a petition before the Lahore High Court, challenging the appointment of Justice Ashraf Jehan Jamali, wife of Chief Justice of Pakistan Anwar Zaheer Jamali, as a judge of the Federal Shariat Court (FSC).

The petitioner stated that Justice Ashraf Jehan Jamali was transferred to the FSC a few months after her appointment as an additional judge of the Sindh High Court (SHC) without approval of the parliamentary committee for judges’ appointment. He stated that even the rules and seniority of sessions judges were ignored during her appointment. He stated that at that time she was a district and sessions judge, from where she was elevated as additional judge of the Sindh High Court in 2013.

He said that the president of Pakistan on September 1, 2014 extended for a year the tenure of Justice Ashraf Jehan Jamali as an additional judge of the SHC when she was working as a judge of the FSC at that time.

He stated that she was repatriated to the SHC as an additional judge in October 2014 and was made a confirmed judge on August 26, 2015.

He stated that she was again appointed as a judge of the FSC on August 28, 2015 in violation of Article 203 of the constitution. He stated that the procedure for the appointment of shariat court and high court judges was different.

He alleged that the CJP used his position for the appointment of his wife as a judge of the FSC. He requested the court to set aside the appointment of Justice Ashraf Jehan Jamali as a judge of the FSC.
