IHC summons PMDC chief, registrar over dismissal of staff

ISLAMABAD: Islamabad High Court (IHC) has summoned the President Pakistan Medical and Dental Council (PMDC) and directed him to appear in person before the court in a case regarding alleged illegal termination of a council’s employee.

Despite getting clearance in cases from the Special Court Islamabad, IHC, inquiries by the Federal Investigation Agency (FIA) and the National Accountability Bureau (NAB), the PMDC management had terminated its account officer Ismaeil Fazal for the second time under the same allegations in a bid to victimise him.

The officer had challenged the council’s legal status in the IHC, which angered the PMDC’s current disputed body and the management allegedly used a seven year old bogus case to dismiss him once again. A termination letter was formally issued on January 16, 2017 by the Admn Officer PMDC, Dil Pazeer Ahmed in this regard.

Ismaeil Fazal was dismissed by the PMDC body on February 2, 2010 following an inquiry report of a dummy inquiry committee formed by the then Registrar PMDC Dr. Ahmed Nadeem Akbar who was already facing the charges of about 100 million rupees corruption, sources revealed to this scribe. Later, the IHC set aside the inquiry report and the dismissal order.

The FIA lodged a criminal case against the officer in June 2010 on the recommendation of the PMDC but the special judge central finally acquitted Ismaeil Fazal in March 2016 after a six year trial. The same was sent to NAB which also cleared the officer from corruption charges.

It may be mentioned here that the IHC had already set aside the dismissal order for the officer and had declared the PMDC’s current body as illegal. The PMDC had filed an intra-court appeal against this order and adopted the stance that the Attorney General should be heard before deciding the fate of the council, which was accepted by the court.

The council had not made any prayer regarding the matter of Ismeil Fazal in the ICA but managed to illegally issue dismissal orders of the officer by allegedly misinterpreting court orders, sources further said.

On the basis of misuse of powers to victimise him, the sacked officer had moved a CM in IHC, which was heard by Justice Mohsan Akhtar Kiyani.

The court had summoned the President PMDC Dr. Shabbir Lehri, Registrar PMDC, Azhar Shah and Admn Officer Dil Pazeer Ahmed on January 25, 2017 to clear their position regarding the dismissal orders for Ismaeil Fazal.
