ISLAMABAD: The Supreme Court of Pakistan (SCP) turned down a petition filed by accused Ishtiaq against fine imposed by Islamabad High Court (IHC) in the case of a second marriage without consent of his first wife.
A three-member bench headed by Justice Dost Muhammad Khan heard the case on Friday.
During the course of hearing, the counsel for the accused informed the court that the trial court sentenced him to one month imprisonment, adding that later the IHC commuted the one month imprisonment into a fine of Rs 5,000.
He told the court that the Union Council (UC) registered a case on the complaint of the wife of the accused.
During the course of the hearing the accused said that “wife is also like life-imprisonment” and “my client has two wives.”
On which Justice Qazi Faez Esa while scolding the counsel remarked that “wife is not like life-imprisonment but blessing of God”.
The counsel informed the court that the accused was paying the expense of his child. On which justice Dost Muhammad Khosa asked how much the accused earned. The counsel responded that the accused earns Rs 12,000 a month.
Justice Khosa remarked that how could a person who is earning Rs 12,000 per month afford a second wife?
The counsel replied that the accused’s second marriage is only on the basis of his nobility.
It is vital to mention here that the accused, a resident of Multan married the second time without the consent of his first wife.
