ISLAMABAD: A Sessions judge on Tuesday filed a reference against Chief Justice of Pakistan (CJP) Justice Saqib Nisar in the Supreme Judicial Council accusing him of ‘misconduct’.
Kohat District and Sessions Judge Ahmad Sultan Tareen filed the reference via courier on Tuesday saying that ‘the CJP’s recent actions are a violation of the Article 209 Code of Conduct. It was further requested that action be taken against Justice Nisar by the Supreme Judicial Council.
The complainant also mentioned that non-disclosure of the agenda behind the recent meeting between the CJP and Prime Minister Shahid Khaqan Abbasi is a violation of the Article 19-A of the Constitution, which guarantees the right of citizens to have access to information in matters of public importance.
While referring to Justice Nisar’s “remarks during speeches and interviews to the media”, it was mentioned that “are such remarks giving a good name to the judiciary?”. It was further said that such remarks are a ‘disrespect’ to the position of chief justice.
It was further questioned that as Chairman of the National Judicial Policy Making Committee, “has the chief justice ensured provision of justice and has he fulfilled his responsibilities to improve the system?”
“Does the CJP have any ethical justification of forcing bureaucrats and politicians to do their job?” it was inquired.
