The government’s decision of allowing dual-national Pakistanis to contest elections in the country and hold higher positions needs more deliberation before making it the law of the land. Soon after returning from the US after a highly successful visit, Prime Minister Imran Khan presided over a meeting of the federal cabinet wherein he said the diaspora wants to contribute to the country’s political and economic system. In this regard, a 10-member committee has been formed to suggest ways to integrate dual-national Pakistanis into the country’s political system in order to make them members of parliament. The prime minister is highly popular among overseas Pakistanis, which was exhibited at the well-attended rally at Washington’s Arena One Complex during his recent visit. The state policy to exclude dual-national Pakistanis from assemblies and government posts is often dubbed as an isolationist mindset in this age of globalisation. Many legislators, who concealed their citizenship of another country in their election nomination papers in 2008, had to give up their assembly membership in 2012 under a Supreme Court ruling. The restriction on overseas Pakistanis to contest elections stems from Article 63(c) of the Constitution, which reads, “A person shall be disqualified from being elected or chosen as, and from being, a member of the Majlis-e-Shoora (Parliament), if he ceases to be a citizen of Pakistan, or acquires the citizenship of a foreign state.” In 2018, the Supreme Court also barred government officials from holding dual nationality. If the government wishes to see overseas Pakistanis in the assemblies, it will have to amend the constitution, which requires a two-thirds majority in both the houses. This also means the government will have to seek support of other political parties, which may be difficult in the current situation. On the issue of voting and election rights to overseas Pakistanis, the Pakistan People’s Party (PPP) had taken a clear position in 2012 that they should be allowed to contest and, if elected, they should give up their foreign nationalities. The Pakistan Muslim League-Nawaz (PML-N) may also agree to the new realities as its leader was disqualified for holding an iqama and doing an overseas job. The inclusion of the diaspora in legislation will have to be treated with caution. It has yet to be seen just how, even if allowed, overseas Pakistanis will cultivate their constituencies at Pakistan, which demands a lot of work on the ground. Laws must demand unquestionable loyalty from them for the state. Similarly, the diaspora will have to show their interest in objective politics. *
