The Bureau of the Assembly of States Parties to the Rome Statute announced the decision on Monday, stating that Khan will face disciplinary proceedings before all 125 ICC member states. The move follows the completion of an investigation conducted by the United Nations Office of Internal Oversight Services (OIOS), although the findings of the report have not been made public.

In a statement, the Bureau said its decision was based on the UN investigation report, supporting evidence, advice from an ad hoc panel of judicial experts, and written submissions. The governing body added that all related documentation would remain confidential to protect the privacy and rights of those involved and to preserve the integrity of the ongoing process.
Khan stepped aside from his role in May 2025 while the investigation was underway. He has consistently denied any wrongdoing and previously stated that the inquiry cleared him of misconduct. In media interviews earlier this year, Khan said the UN report contained no findings that could be interpreted as inappropriate conduct or abuse of authority.
The investigation began in November 2024 after a member of Khan’s office accused him of sexual misconduct. A second woman later came forward with allegations that he had abused his position while she worked under his supervision.
The case has attracted significant international attention because it coincided with the ICC’s high-profile investigations into alleged war crimes and crimes against humanity in conflict zones, including Gaza. In May 2024, Khan announced his intention to seek arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant over alleged crimes linked to the Gaza conflict.

An extraordinary session of ICC member states is expected to be convened soon to consider the disciplinary proceedings against Khan.
