PESHAWAR: A division bench of Peshawar High Court on Wednesday suspended execution of a militant, who awarded death sentence by a military court and sought record of his trial. The bench consisting of Chief Justice PHC Mazhar Alam Khan Miankhel and Justice Ikramullah Khan was hearing a writ petition filed by Alam Khan through his counsel Barrister Amirullah Chamkani. Arguing before the bench, Chamkani said that petitioner’s bother Muhammad Umar, who is a resident of Battagram, was arrested by personnel of intelligence agencies on August 10, 2014 from Mansehra. He said that his whereabouts remained unknown since then however his family came to know on May 3, 2016 that he was awarded death sentence by a military court and his execution was approved by Chief of Army Staff. He argued that the convict was sentenced to death on charges of having affiliation with terrorist organization, attacks on security forces and keeping explosive materials. Chamkani said that military courts were set up after 21st Constitutional Amendment for which rules and regulations were devised under which these courts would try suspects under Code of Criminal Procedure (CrPC). He argued that under CrPC the suspects would be given a chance to defend himself, however, neither he was allowed to hire his lawyer nor he was given a chance to defend himself which was illegal and unconstitutional. He prayed the bench to set aside military court sentence after which the bench stayed his execution and sought provision of record of his trial.
