ISLAMABAD: The Supreme Court (SC), while ordering to shift minor maid Tayyaba, a victim of violence, to the SOS Children’s Village for two months from next Monday has adjourned the hearing of the suo moto notice case indefinitely. The court remarked that Tayyaba would stay in the SOS Village for two months and then after asking her “we will review whether she has to be handed over to the parents or whether she has to be sent somewhere else. Sweet Homes does not lack any thing. But the courts objective is to provide the minor girl the best environment. A three-member bench of the SC presided over by the Chief Justice of Pakistan (CJP, Mian Saqib Nisar, took up the case for hearing on Tuesday. Mian Saqib Nisar, while expressing resentment over the attitude of the parents of Tayyaba remarked “we dont want to keep her away from her parents. But her parents did nothing for her protection. Parents are even not ready to contest the case of Tayyaba. Her father gave a statement in the SC and later backed out from the same. What words we should use for such a father,” the CJP asked. The counsel for the accused, Mahin Zafar, said the high court had reserved the judgment about the transfer of the case. The Advocate General (AG) said if the trial of the case was shifted to the high court then the right of appeal of the accused persons would be affected. The CJP remarked the court is entitled to transfer the case. “So let us wait for the decision of the high court. The case will be transferred to Rawalpindi if we deem it proper. The court adjourned the hearing of the case for an indefinite period after hearing the parties concerned.
