ISLAMABAD: Supreme Court (SC) has allowed Capital Development Authority (CDA) to take action against the ‘fresh’ slums established after the interim relief on demolishing slums of sector I11 in the federal capital. The court also directed the government to seek assistance from ‘Google Maps’ and point out the areas occupied illegally after the interim relief and submit its report. A divisional bench of SC comprising Justice Mushir Alam and Justice Dost Muhammad on Wednesday ruled that the lack of timely action encouraged the people who occupied the public places. While pointing out the flaws in policies of provinces regarding slums, the top court observed that no section had been introduced for town planning to settle the shelter-less people and slums. The top court directed the provinces and federation to allocate funds in the coming budget for gathering the accurate data, mapping, legislation and administration to settle the slums with the assistance of survey of Pakistan. The court also selected Law and Justice Commission Secretary Sarwar Khan as coordinator of expert working group and directed him to summon the meeting within 15 days and submit its report before the court within a period of month. However, the top court expressed reservations on Punjab’s provincial report and directed to revisit the policy regarding the allotment of one kanal to each slum in the province. The court also remarked that the drawn policy would benefit the officials of the departments and land mafia. Additional Advocate General Razaq Mirza informed the court that five marlas in urban and 20 marlas in rural areas had been given to slums as an alternate adding that there are total 220 slums in the province. He said that more than 72,000 plots were allotted to low-income people through different government schemes while 20 percent quota was also allotted to them in private housing schemes. The top court also rejected the Sindh government’s report and directed for strict action against competent authority responsible for submitting incomplete report. Justice Alam observed that he belonged to the said province and he know how people occupy the lands. He observed that there are many schemes on the name of Shaheed Bhutto. He queried that whether the public was benefited from the funds of United Nations (UN) on the name of Shaheed Bhutto. He further asked the Sindh additional advocate general regarding the steps for occupying the lands illegally. Balochistan government informed the court that recommendations had been done for fresh survey and so far there are 60 slums in the entire province. Khyber Pakhtunkhwa (KP) informed that there was only a single slum in Peshawar, which had been regularised. CDA’s Counsel Munir Paracha informed the court that people had occupied green belts, parks and apartments in the garb of interim order issued on August 26, 2015. He pleaded to vacate the interim order. However, the court rejected the plea and directed CDA to submit the report regarding recent slums after the interim order.
