ISLAMABAD: Supreme Court (SC) while accepting the plea from the affected officers working in the Capital development Authority (CDA) on deputation for becoming party in illegal appointments and promotions of CDA officers case and directed them to file review petitions. A three-member bench of Supreme Court presided over by Chief Justice Anwar Zaheer Jamali took up the case for hearing on Thursday. The counsels for 35 officers who were posted in CDA on deputation appeared in the court. They requested the court to allow them to become party in the case. The court rejected the plea of these officers for granting stay order against the CDA orders. Justice Amir Hani Muslim remarked, “If officers want promotion then they should go back to their parent departments. Court cannot allow breach of anyone’s right. CDA employees cannot go to other departments while employees of other departments can join CDA on deputation and return to their respective departments after getting promotion. The plight of CDA is worse than Sindh. This runs under a board, tell us what is the authority of board”. Chief Justice Anwar Zaheer Jamali remarked, “One officer is appointed in grade-16 in 2004 and he moves to grade-21 in 2008. The employees who are already working in the department are retired from service while waiting for their promotion. Our motive is not to disturb the employees. To us, employees of all the departments are respectable. We know it that the implementation of orders makes no difference to anyone but it makes difference to those whose rights are breached”. Advocate Babar Awan gave arguments on behalf of doctors from CDA. Munir Paracha informed the court about the implementation of court’s orders by CDA. Naeem Bokhari counsel for CDA Labour Union also appeared in the court. The counsel for CDA argued that 35 employees who had joined CDA on deputation have been sent back to their parent departments. The counsel for the affected officers said that the court had sought only report and it had not ordered for sending these employees back to their respective departments. The stay order to be granted against CDA orders. The counsel for other five affected officers said in the court while giving arguments, “I represent five officers who had joined CDA on deputation. They are still in the same grade, which they were holding at the time of their transfer to CDA on deputation. Justice Amir Hani Muslim remarked, “Whosoever has to get promotion should return to his parent department”. The court remarked that who has any reservations on the decision should file a review petition. The court heard the officers who were working in different departments in Sindh on deputation since the last 20 years and were relieved of. The affected officers of CDA should also file separate petitions and they will also be heard.
